Welcome to AMIYHA. The terms “we”, “us” and “our” refer to Amiyha AB. We operate this website and online store, including all related information, content, features, tools, products and services (the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms & Conditions, together with any policies referenced herein, describe your rights and responsibilities when using our Services and purchasing products from us.

Please read these Terms & Conditions carefully before using our website or placing an order. By accessing or using our Services, you agree to these Terms & Conditions and our Privacy Policy.

Nothing in these Terms & Conditions limits any mandatory rights you have as a consumer under applicable Swedish or EU consumer protection law.

You are responsible for ensuring that the information you provide is accurate, current and complete.

If you create a customer account, you are responsible for maintaining the security of your account and for activities carried out through your account.

2. OUR PRODUCTS

We make every effort to display and describe our products as accurately as possible. However, colours and appearance may vary slightly depending on your screen, device and display settings.

As many of our products contain natural crystals and stones, variations in colour, pattern, transparency, texture and appearance may occur. These natural variations are part of the individual character of each stone and do not constitute a defect.

Product images are intended to provide an accurate representation of our products, but minor differences between the product shown and the product received may occur.

We reserve the right to modify or discontinue products and to limit quantities available for purchase.

3. ORDERS

When you place an order with AMIYHA, you submit an offer to purchase the selected products.

Once your order has been successfully placed, you will receive an order confirmation at the email address provided during checkout.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, for example in the event of incorrect pricing, suspected fraud, payment issues or lack of stock. If payment has already been made for an order that we cannot fulfil, the relevant amount will be refunded.

Please review your order carefully before completing your purchase.

Where available, you may request cancellation of an order before it has been fulfilled. Once an order has been processed or shipped, cancellation may no longer be possible. Your statutory right of withdrawal is not affected by this.

Returns and refunds are governed by our Return & Refund Policy.

Products purchased from AMIYHA are intended for personal use unless otherwise agreed.

4. PRICES AND PAYMENT

All prices displayed to consumers on our website include applicable VAT unless otherwise clearly stated.

Any shipping charges or other applicable costs will be displayed before you complete your purchase.

Prices, promotions and discounts may change without prior notice. The price applicable to your purchase is the price displayed at the time you place your order.

Payment is processed through the payment methods made available at checkout.

You agree to provide accurate and complete payment and billing information when making a purchase.

5. SHIPPING AND DELIVERY

Available shipping methods, shipping costs and estimated delivery times are displayed at checkout and/or described in our Shipping Policy.

Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control.

We are not responsible for delays caused by circumstances beyond our control, but this does not affect any mandatory rights you may have under applicable consumer law.

Risk of loss or damage to products passes to you when you, or a third party designated by you other than the carrier, takes physical possession of the products, in accordance with applicable consumer law.

6. RETURNS, RIGHT OF WITHDRAWAL AND REFUNDS

Consumers purchasing online generally have a statutory right to withdraw from a purchase within 14 days in accordance with applicable Swedish and EU consumer law.

Detailed information regarding your right of withdrawal, returns, return shipping costs, exclusions and refunds can be found in our Return & Refund Policy.

Unless otherwise stated or required by law, the customer is responsible for the cost of returning products when exercising the right of withdrawal.

Your statutory rights regarding defective or incorrectly supplied products are separate from your right of withdrawal and are not affected by our return policy.

7. COMPLAINTS AND DEFECTIVE PRODUCTS

If a product is defective, damaged or incorrect, please contact us at info@amiyha.com as soon as possible and provide your order details and information about the issue.

Consumers have the right to make claims regarding defective products in accordance with applicable Swedish consumer legislation.

Nothing in these Terms & Conditions limits your statutory rights in relation to defective products.

All content available through our Services, including but not limited to the AMIYHA name and logo, text, photographs, graphics, product designs, videos and other content, is owned by or licensed to Amiyha AB unless otherwise stated.

Shopify’s names, trademarks and other intellectual property belong to Shopify or its respective licensors.

11. RELATIONSHIP WITH SHOPIFY

AMIYHA is powered by Shopify, which provides the ecommerce technology that enables us to operate our online store.

However, purchases made through our store are made directly between you and Amiyha AB. Shopify is not the seller of the products offered by AMIYHA.

Your use of certain Shopify functionality may also be subject to Shopify’s applicable terms and privacy practices.

We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).

These Terms & Conditions, together with the policies and information referred to herein, constitute the terms governing your use of our Services and purchases from our online store.

Failure by us to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

19. GOVERNING LAW AND DISPUTES

These Terms & Conditions and purchases made from AMIYHA are governed by Swedish law, without limiting any mandatory consumer rights that may apply to customers residing in another country.

Consumers in Sweden may also have the right to refer a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), subject to its applicable requirements.
